Please read these Terms & Conditions (“Terms”) carefully. They govern your use of the website www.signatureartlab.com (the “Website”) and the services offered by Signature ArtLab. By using our Website or submitting a request, you agree to be bound by these Terms.
1. General Information
1.1 The Company
The Website is operated by Signature ArtLab (“we”, “us”, “our”), a company based in The Netherlands and registered with the Dutch Chamber of Commerce (KvK).
Chamber of Commerce (KvK) number: 95933743
Email: info@signature-artlab.com (all correspondence related to these Terms should be sent to this address).
1.2 Scope
These Terms apply to all visitors and users of the Website and form the basis for all requests and orders for our custom artwork services, unless agreed otherwise in writing (e.g. in an individual quote or contract).
1.3 Privacy & analytics
We use privacy-friendly analytics (e.g. Simple Analytics) to measure and improve the use of our Website. This measurement is aggregated and is not used to identify individual visitors.
In addition, we use strictly necessary functional cookies to ensure the proper operation of our Website, including the temporary storage of form inputs to prevent data loss in the event of a page refresh or interruption.
Where you consent, we also use Google Analytics and Google Ads and related tags for advertising and conversion measurement (cookies/identifiers). If you do not consent, we do not place marketing cookies, but we may still use aggregated, privacy-friendly (cookieless) measurement.
If you arrive via an advertisement and then choose to submit a form, an ad click ID from the URL may be stored with your submission for attribution and conversion measurement (including manual conversion attribution in Google Ads).
Further details are set out in our Privacy Policy, which forms an integral part of these Terms.
2. Website Use and User Responsibilities
2.1 Lawful Use
You agree to use the Website only for lawful purposes and not to engage in activities that:
- violate applicable laws or regulations;
- infringe the rights of others (including intellectual property and privacy rights); or
- compromise the security or functionality of the Website (for example by uploading malware or using automated bots that overload our systems).
2.2 Accuracy of Input
When you provide information, ideas, photos, or files (the “Client Input”) for a custom painting, you confirm that this information is accurate and that you have the legal right to share the Client Input with us for the purpose of creating the artwork.
3. Intellectual Property (IP) and Licensing
3.1 Ownership of Website Content
All text, graphics, logos, software, and other materials on the Website are owned by Signature ArtLab or its licensors and are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Website for personal, non-commercial purposes only. You may not copy, reproduce, distribute, or modify our content without our prior written consent.
3.2 Ownership of the Artwork
- Client Input – You retain the intellectual property rights to your original Client Input (e.g. the photograph or sketch you upload).
- Artwork Process & Final Design – Signature ArtLab retains the intellectual property rights to the generated digital design, the robot’s painting process, and the underlying artistic concept (the “Artistic IP”).
- The Physical Painting – When you purchase an artwork, you own the physical object. However, you do not acquire the Artistic IP or copyright to reproduce, adapt, or commercially exploit the design without our explicit written agreement.
3.3 License to Use Client Input
You grant Signature ArtLab a worldwide, non-exclusive, royalty-free license to use, reproduce, adapt, and transform the Client Input solely for the purposes of:
- creating, producing, and delivering your specific custom artwork; and
- showcasing the resulting final artwork and the artistic process in our portfolio, on our Website, and in promotional materials (e.g. social media), unless we agree otherwise in writing or you reasonably object.
If you do not want your artwork to be used in this way, please inform us in writing and we will take this into account where reasonably possible.
4. Orders and Custom Services
4.1 Agreement
A binding agreement for a custom artwork is only formed when:
- we confirm in writing (e.g. by email) that we accept your order or quote; and
- you accept the terms and make any required (down) payment.
4.2 Refusal of Request
We reserve the right to decline any request that we consider not feasible, unlawful, inappropriate, or not aligned with our artistic direction or studio capacity.
5. Right of Withdrawal (EU Consumer Protection)
5.1 Custom Goods Exemption
If you are an EU/EEA consumer, you acknowledge that, under applicable consumer law, the statutory 14-day right of withdrawal (cooling-off period) generally does not apply to goods that are made to the consumer’s specifications or are clearly personalised.
Because almost all our physical artworks are custom-made, personalised goods created specifically based on your instructions, the 14-day right of withdrawal does not apply once the order has been confirmed and the customisation process has begun.
5.2 Mandatory Rights
Nothing in these Terms affects your mandatory consumer rights regarding faulty or non-conforming products. These rights may include, for example, the right to repair, replacement or a refund if the artwork is faulty or does not match what was agreed.
6. Prices, Payment and Delivery
6.1 Prices and Payment
Details on prices, applicable taxes, payment terms, and delivery or installation costs will be specified in the individual quote or order confirmation.
6.2 Delivery
Delivery times are indicative. We are not liable for delays caused by external factors or events beyond our reasonable control (such as transport issues, customs delays, technical failures or force majeure events).
7. Disclaimer and Limitation of Liability
7.1 Disclaimer
The Website is provided “as is” and “as available”. We do not guarantee that the Website or its content will be error-free, secure, or constantly available, or that the information on the Website is complete or up to date at all times.
7.2 Limitation of Liability
To the fullest extent permitted by Dutch law, Signature ArtLab shall not be liable for any indirect, incidental, special, or consequential damages, or for any loss of profits, revenue, data, goodwill, or business opportunities arising out of or in connection with your use of the Website or our services.
7.3 Total Liability
Our total liability for any claim arising out of or in connection with these Terms or the artwork provided shall be limited to the amount you paid to us for the specific artwork in question. For example, if you purchased a painting from us, our maximum liability in relation to that painting will be limited to the price you paid for it.
Nothing in these Terms limits or excludes liability where such limitation or exclusion would be unlawful (for example in cases of intent or gross negligence).
8. Governing Law and Jurisdiction
8.1 Governing Law
These Terms and any disputes arising from them (including non-contractual claims) are governed by and construed in accordance with the laws of The Netherlands.
8.2 Jurisdiction
Disputes shall be subject to the exclusive jurisdiction of the competent courts in Rotterdam, The Netherlands, without prejudice to any mandatory rights you may have as a consumer to bring a claim before the courts of your place of residence.
9. Modifications and Contact
9.1 Changes
We may amend these Terms at any time. The updated version will be published on the Website with a new “Last updated” date. By continuing to use the Website after the changes, you accept the revised Terms. If you do not agree with the changes, you should stop using the Website.
9.2 Contact
For any questions about these Terms, please contact us at: info@signature-artlab.com.
